The supreme court has issued an emergency order temporarily blocking full Snap food aid payments.

The high court’s order came after the Trump administration asked a federal appeals court on Friday to block a judge’s order that it distribute November’s full monthly food stamp benefits amid a US federal government shutdown.

After that request to block was denied, the Trump administration turned to the supreme court in a further attempt to block the order to fully fund Snap food aid payments.

The application to stay reads: “If forced to transfer funds to Snap to make full November allotments, there is no means for the government to recoup those expenditures – which is quintessential irreparable harm. Once those payments are made, there is every indication that the States will promptly disburse them. And once disbursed, the government will be un-able to recover any funds. Worse, these harms will only compound if the decision below stands.

    After a Boston appeals court declined to immediately intervene, Supreme Court Justice Ketanji Brown Jackson issued an order late Friday pausing the requirement to distribute full SNAP payments until the appeals court rules on whether to issue a more lasting pause. Jackson handles emergency matters from Massachusetts.

      Here’s one analysis:

      Jackson gets this application because it’s from the 1st circuit, and she is assigned to initially handle all shadow docket matters from the 1st circuit. By writing this admin stay, she potentially keeps the full court from stepping in and doing it for her. And this way she gets to set the 48 hour limit. This could cause the whole case to be decided one way or another a lot faster.

      The supreme court let the trans passport case sit on the shadow “emergency” docket for 48 days. This stay gives the 1st circuit approx the weekend to make their decision, then the 48 hour deadline puts some oomph on the rest of scotus to make their decision.

      If Justice Jackson did nothing, and 5 votes on the court intervened to issue a stay at 1 am, then there would be no 48 hour limit.

        When you consider the strategy here, and the potential downsides if Jackson didn’t issue this stay, it makes more sense why she did it.

        We’ll see how SCOTUS rules on it. Hopefully they’ll be on the side of fucking humanity

        That is a fact. They want an excuse to start deploying the military and I hope to God there’s enough officers in the military that has enough balls to support the Constitution and not the fucking dictator. They are trying to push a civil war

          There is no one who could fight the feds in a civil war right now. They want domestic violence, riots, that they can crack down on to take more power and train people to accept domestic occupation.

          Wars require combatants. The troubles in Northern Ireland was not a civil war, and the IRA was far more organized than anything that exists now here in the states.

          They want a fight because they think they can win.

            When you say they do you mean the military? The military has no arrest authority over civilians. The posse comitatus act specifically says that. When I was in the military we spent two days going over the posse comitatus act and what the military is allowed to do. That was part of my officer training. There is no legal recourse for the military to do anything. If civilian leaders give illegal orders the only thing the military can do is look at the civilian leader and say no that’s against the Constitution and we cannot do that. It was set up specifically like that to keep the military from trying to take over. Because you know a general could say hey civilian guy giving illegal orders we can arrest you or the general could say hey civilian in any situation we can arrest you and hold you indefinitely. The purging of the brass in the military and especially the upper echelon officers is really what is disturbing about this. The fact that there are military officers that are willing to go against the Constitution is even more deeply disturbing. I’m not really going to blame some 19-year-old recruit that just come out of basic because they don’t know any better but they’re NCOs and officer corps sure as fuck does. And that’s where the real problem lies. Just like Bannon recently that the Republicans better take over the institutions or we’re all going to jail in 2028 so he knows they know that all this shit is illegal but here we are

          Take the Texas national guard, tell them Portland has been overrun by Antifa, and send them in. That’s the trick. If you send the locals, they won’t do it. You have to get people who will listen to you and aren’t local, that way they don’t think they’re fighting their neighbors.

          For example, at Tiananmen Square, they called up hundreds of thousands of troops from outside Beijing, not just for pure numbers, but because they would be less sympathetic to the students.

          They already know this. That’s why Stephen Miller is doing this exact thing.

          When the local national guard units are deployed for riot control, usually they do a relatively good job. In the 1992 LA riots, there were a couple thousand CA guardsmen (I can’t find a solid number) plus a couple thousand more other law enforcement, over 12,000 arrests, and 63 dead, of whom 9 were shot by police and only one by the national guard.

          (Kent State is the notable exception.)

        Seriously. Not getting aggressive with Nixon directly lead to trump and this whole criminal administration. Sherman didn’t march far enough.

        We really need more AOCs and the other three. And definitely more Mandami’s, but aggressive, in local positions.

      The Supreme Court Problem should be a top priority in the 2026 Midterms. People are already tired of being pushed around by the Supreme Court, which is supposed to protect us from government overreach.

      Interracial and Gay marriage are on the chopping block under MAGA, and who knows what else these psychopaths will think of? People are scared of how the Supreme Court is being manipulated.

      Dems need to run on increasing seats on the the Supreme Court, and impeaching Clarence Thomas for his many, many crimes.

      Add 4 seats, get rid of Thomas, and the Dems would have 8 seats, and MAGA would have 6. And if a MAGA seat opens up, Dems need to go to war to take that seat, McConnell style.

        thomas and alito both, are obviously paid for. everyone else on the bench should have their entire lives upended in a very thorough fbi investigation, uncover and publicize any and all skeletons they have hidden in the closest then impeach as necessary.

          Thomas is definitely a proven corrupt justice and a traitor, and his wife is also a proven traitor. Alito is an American hating traitor, but I don’t recall him doing anything that’s actually illegal, although I could easily be wrong. I hope I am, because if there’s some way to toss him in jail - for his CRIMES, not his politics - then I’m happy to be wrong.

    My deepest sympathies to all Americans, even the ones who support Trump. At the end of the day, they’re just victims of the system like the rest. And no matter the outcome of the last election, this was inevitable, Trump or no Trump. At best it could have been postponed by a few years.

    I wish it was different, but I can’t see all of this ending with anything less than a full blown revolution and/or world war. Nobody wants this and everyone would like to avoid this, but it just doesn’t look at all possible right now.

    After long decades of enslavement, brain washing, tyranny, and terror, a good chunk of Americans is realizing that there’s no world in which this is acceptable or excusable.

    In addition, there’s finally again a superpower to rival the USA.Whatever your feelings on the USSR or China - there can never be just one superpower, because we’ve seen what that leads to. I wish it was the European Union, but it looks like the USA was mostly successful in destroying all efforts for Europe to become truly great and powerful. At the very least China is currently more friendly than the USA has ever been. Let’s hope they keep this attitude even after America crumbles. That’s probably the most optimistic scenario I can think of.

    Like the messages on government websites blaming democrats for the shutdown, snap recipients should be directed to the homes of the members of the Supreme Court, to find who is to blame. Ruling on other’s hunger. This is no high court.

        That’s not true, most of you voted for this or approved of it by not voting. That’s not to say all of you. There are millions of Americans against this and we support you, but the problem is that the majority are, well, fucked. That’s what needs to be addressed.

          There are tons of people who both “voted for this” and are not doing okay.

          They did the fucking around. Now they’re finding out. (Or not. In which case they’re still suffering, they’re just too brainwashed and/or ignorant to appropriately assign blame.)

          Which means that in a way, you’re both right. But whatmeworry’s point that this will take time can’t be understated. It’s frustrating how many people are complaining about the speed of this all, as if similar events in the past didn’t take years to resolve. It’s exhausting to be suffering under fascists, attempting to foster local community (in a strongly “individualist” society) in order to have strength against said fascists (especially as someone with social anxiety), and then coming online to read the opinions of ignorant outsiders bitching that we haven’t yet overthrown a billionaire-driven, military-backed, surveillance-owning government that possesses a band of legal kidnappers.

          I mean, hot damn, just because it takes minutes to read a synopsis about historical revolutions doesn’t mean those revolutions occurred within minutes.
